Almost Campaign Time

For a mere 1% of the annual salary, anybody in the proper district can run for County Commission. Anybody need a dollar? Do you know what the responsibilities of the County Commission are? What goals would you set for a new - or returning - Commissioner?

WEST VIRGINIA CONSTITUTION:
9-11. Powers of county commissions.
The county commissions, through their clerks, shall have the custody of all deeds and other papers presented for record in their counties, and the same shall be preserved therein, or otherwise disposed of, as now is, or may be prescribed by law. They shall also, under such regulations as may be prescribed by law, have the superintendence and administration of the internal police and fiscal affairs of their counties, including the establishment and regulation of roads, ways, bridges, public landings, ferries and mills, with authority to lay and disburse the county levies: Provided, That no license for the sale of intoxicating liquors in any incorporated city, town or village, shall be granted without the consent of the municipal authorities thereof, first had and obtained. Until otherwise prescribed by law, they shall, in all cases of contest, be the judge of the election, qualification and returns of their own members, and of all county and district officers, subject to such regulations, by appeal or otherwise, as may be prescribed by law. Such commissions may exercise such other powers, and perform such other duties, not of a judicial nature, as may be prescribed by law. Such existing tribunals as have been heretofore established by the Legislature to act as to police and fiscal matters in lieu of county commissions in certain counties shall remain and continue as now constituted in the counties in which they have been respectively established until otherwise provided by law, and they shall have and exercise the powers which the county commissions have under this article, and, until otherwise provided by law, such clerk as is mentioned in section twelve of this article shall exercise any powers and discharge any duties, heretofore conferred on, or required of, any such tribunal or the clerk of such tribunal respecting the recording and preservation of deeds and other papers presented for record and such other matters as are prescribed by law to be exercised and discharged by the clerk thereof.

Hope this doesn't fall within personal attacks. It's not meant to do that but in order to save the County from a lawsuit which I am afraid will eventually come about costing us precious dollars, taking the Ten Commandments plaque off the wall in the County Commission room should be done.

I know this will probably cause many to yell at me, but I think the laws regarding church and state are clear. However, if anyone should make taking down the Ten Commandments sign part of their campaign, they would probably be tarred and feathered.

b...rulz, I totally agree. It might be "just a plaque," but the words mean something to some of us. Personally, I wouldn't have the cojones to say, "Nanny nanny boo boo" to their author by using them as a target in a p*ssing contest.

Filing fee is 1% of the Commissioner salary, which in Clay is $23,000 per year. That makes it $230 (my Clay County edjukayshun paying off!).

Run for office on pauper filing?? LOL That's hilarious!!

I believe the ten commandments question is not a question of religion versus state as defined in our constitution but a question of which should take precedence the laws of GOD or the desires of man. our constitution is only the "wishes" of a group of men. wishes that should only be enforced with the approval of "all" the people. currently our country is being run by a secret, tax exempt org. called the FREEMASONS. actuaolly we [NONMEMBERS] are being used for the benefit of the FREEMASON members, their families, and the people they select. or do not oppose.
it is my belief that the laws of GOD which were given to Moses on Mt. Sinai, predating both the christian and the jewish religions, should take precedence the lone stranger

The freemason organization is not a secret. Even got a movie out that has them as a center piece. American Treasury or something like that. Opened in theatres a couple years ago and it was about a treasure hunt that lead to Washington DC. Where the earlier freemasons had stashed some foriegn loot that they recieved in a deal of some sort.

Well anyway i am not a freemason but as a veteran and a member of the American Legion i can say that i have a lot of friends in the masonry. They will not talk about their procedures and what goes on in secret, but i have learned a little about them. The organization itself is tax free and so are many other non profit groups. They are a non profit group that turns money back into our society. You will never see where they have built things, because you are right on the secretive part when it comes to seeking the recognition.

You are getting all the action, nothing happening on the other sites. There have been some intelligen information provided on here this afternoon, where did all these people come from, wow, it's hard to believe but of course I always known about your light, it was always bright!!!
I honestly don't believe anything will ever change in Clay County, I had always hoped to move back home some day and perhaps some good things would change in the position of authority!
Even though some of the names have change the mentality and attitude has not," it must be in the water"
Anyway, my hat is off to the people that are trying to make improvement to the County..

Ahh, campaign time again. So soon. The litter from the last campaign is still around in some places. I hate those silly signs stuck everywhere you look. Trashes the whole county. And why anyone would allow their front lawns to be filled with them is beyond me. I know, name recognition. That's the whole purpose of the signs. The candidates know that some will mark by their names just because they have seen it a thousand times. Too bad people don't take the time to actually get to know the candidates and what they stand for unless they are like me and don't believe a word any of them say. At least, that's been my experience.

Come on Rose, you might be our only hope. What do say folks?

There is a gang of things the ccc is responsible for,sit in on a few meetings and get a free education on there duties. From past experience, we in Clay Co. learned, that to be elected to the ccc means one only has to attend only a couple of meetings a year. Fran,Pete,and Jimmy, keep up the good work! For everybody's information the fee for County Commission is $203.00 Because your salary is only $20,300.00 per year or $390.38 per week or on a week and a 7 day week working 10 hours a day is $5.57. Do you remember the water leak here at valley fork 1 of the county commissioners was here from 9 am till 2, 3, and 4 am for 3 days until we got water so don't critize her or her pay. She earned every dollar of it.

Geez!! It's the "hippys" that keep us years behind the rest of the world. There's already a communist behind every tree. It's illegal to use a legal product (tobacco). Maybe the hippy would like to fork over the dollars a law suit will cost the county and let the rest of the tax money we all pay go for more law enforcement or anything that will benefit the entire county instead of getting votes for and providing jobs for Mr. Sams, Mrs. Sams and the whole Sams family. Good grief. Give me a break!!

Wooeee, Rose. Getting warm in here. What fun it is to come to your blog. Never know where it will go from your original post. hippy got all hot and bothered. You know, there are very few of us who don't have family and/or friends who fought in Nam and also now have them fighting Bush's war.

Sometime back, we had a little discussion about the tobacco banning deal. What do we tell our men and women that choose to use tobacco when they come home from the war?

Thank you very much, but you're in the USA now, so put out that cigarette; go get a job and pay your taxes so the CCC can have money to pay their attorney.

Sometimes common sense should tell our elected ones to pick their battles wisely. I have the Ten Commandments in a frame on my wall and try my very best to live by them. Those of us who do this don't need a public display and the ones who don't try to follow the Ten Commandments could care less whether it's on the wall at the Courthouse or not.

I knew I would get yelled at sooner or later. teeheehee. That's okay. I can handle it.

12/23/05-Ten Commandments Display Upheld by Sixth Circuit Court of Appeals- Display is identical to the one argued before the Supreme Court earlier this year
Cincinnati, OH - Handing the ACLU a significant defeat, the Sixth Circuit Court
of Appeals held today that a display of the Ten Commandments together with other historical documents in Mercer County, Kentucky, is constitutional. Liberty Counsel represents Mercer County. Liberty Counsel also represented Elkhart County, Indiana, in which the Seventh Circuit earlier this year upheld an identical Ten Commandments display. Liberty Counsel also represented two Kentucky counties, McCreary and Pulaski, before the U.S. Supreme Court earlier this year involving the same display.

This case began when the ACLU sued Mercer County for its "Foundations of American Law and Government" display in the county courthouse that contained the Ten Commandments. The display included the Ten Commandments, the Mayflower Compact, the Declaration of Independence, the Magna Charta, the Star Spangled Banner, the National Motto, the Preamble to the Kentucky Constitution, the Bill of Rights to the U. S. Constitution, and a picture of Lady Justice.

Today the Sixth Circuit adopted the reasoning of the Seventh Circuit in Books v. Elkhart County, a Liberty Counsel case where the Seventh Circuit upheld an identical display to that in Mercer County. The Sixth Circuit stated, "Our concern is that of the reasonable person. And the ACLU, an organization whose mission is 'to ensure that ... the government [is kept] out of the religion business,' does not embody the reasonable person." The Court's opinion also rejected the ACLU's "repeated reference to 'the separation of church and state.' This extra-constitutional construct has grown tiresome. The First Amendment does not demand a wall of separation between church and state."

Mathew D. Staver, President and General Counsel of Liberty Counsel, hailed today's decision as a great victory. Staver stated, "Today's decision begins to turn the tide against the ACLU, which has been on a search and destroy mission to remove all vestiges of our religious history from public view." Staver added, "Whether the ACLU likes it or not, history is crystal clear that each one of the Ten Commandments played an important role in the founding of our system of law and government. Federal courts are beginning to rightfully reject extreme notions of 'separation of church and state.' It's about time that courts begin interpreting the Constitution consistent with its original purpose. With the changing of personnel at the U.S. Supreme Court, the trend toward a more historical approach to the First Amendment is well underway." Staver concluded, "This case should be used as a model for other counties wishing to display religious documents and symbols, including the Ten Commandments. It's absurd to think that displaying the Ten Commandments is unconstitutional. The Ten Commandments is a universally recognized symbol of law. Our laws, and our notions of right and wrong, have been shaped by the Decalogue." (Reprinted from "Liberty Counsel ALERT!" December 20, 2005)

Reprinted from "Liberty Counsel ALERT!" December 20, 2005.... that's the sad part. What was left out of the article in the Free Press was the part that made the OH case so damning to Sams.
The Court ruled the display could remain so long as all the type and type styles were identical in size and color and elevation on the wall.
Has anybody noticed Sams' display? It's got to go!

Let's see, now. What needs of the people could be met with money spent on a lawsuit that could be prevented?

How about a "Meals on Wheels" for the elderly who live alone?

A child care center for single parents or the married ones who have to work because in today's economy, sometimes it's a have-to case.

More money in the budget for the Volunteer Fire Departments. Those people are awesome. They do it all. Fight fires, clear roads, traffic control. Almost without exception, they are the first ones on the scene of accidents, fires, fallen trees, etc.

More money in the budget for the Ambulance Service (and not for pay raises necessarily) but to add at least one more crew. Anyone who has a scanner knows how badly that is needed.

Also for the elderly citizens who are alone those thingys that they can wear around their necks and just push a button to summon help if they should fall and can't get to the phone.

I'm sure there are other needs that could be met, but that's all I can think of this early in the morning.

Thanks, anon. I wasn't aware of the program. Am really glad to know that we do have the Meals on Wheels program. I'm sure it's greatly appreciated by those who need it even if it does have to be provided by another county. Just too bad we have to depend on other counties to provide for our folks, but it's better than not having it at all.

hey rose; the main problem with clay co, is first a welfare mentality. its always maybe we can get a grant or how can we get someone to give us the money. then we have these people who will let nothing happen in the county unless they control it and profit from it. i'm hipped on the subject, who else but the FREEMASONS. i've been there i had a business. i was boycotted by them and put out of business. was told by one of their members of this who said he wasn't even supposed to be in my place. and who will remain anonymous. CLAY COUNTYs BIGGEST PROBLEM IS THAT LODGE THAT SETS ON THE CORNER ACROSS FROM THE CLAY CO. BANK. the lone stranger

I think the "welfare mentality" and seeking grants are two different issues.

There are literally billions of dollars available in WV for various economic development projects, county improvement issues, etc.

The Grantors are going to give that money to SOMEBODY, why not us? They're not going to come knocking on our door, begging us to take it, though. We've got to elect people who will actively pursue & secure that money.

Just for kicks, I did a google search based on, "county commission, west virginia, grant" & came up with over 43,000 hits. Add "Clay County" to that criteria & you're down to 500 or so. Weed out the inapplicable verbiage & you're left with ... very darn little.

hey rose i didn't say not to accept grants. i suggested how they could cut a lot of their expenses in clay co. didn't get anywhere. linkanauger wouldn't have got his deal through. i expect someplace along the line some one will get a bonus for putting the deal through. at least that's the way it was done when a certain ex-ass't school supt. was in office. he always got a job and at the completion of the project a $50,000.00 bonus[kickback?] a schoolboard member tried to locate the source but said it was buried so deep in the architects fee it couldn't be separated out. the lone stranger
